Acceptance of the buyer’s purchase order is subject to our written confirmation and advance payment received against the order. Delivery of the goods as per the purchase order, between 7 and 10 days, is subject to the force majeure clause and advance payment received. If advance payment is pending against the acceptance of the purchase order, the seller has the option to cancel the contract and shall under no circumstances be liable for non-delivery of material.
Ordered quantity and delivered quantity weight may differ by 5% +/- per MT, and the buyer should accept the same. The material’s test certificate and weighment slip of the vehicle shall be provided with each consignment.
The buyer/consignee should inspect the materials on the arrival of the vehicle at the destination before unloading. If the material is not as per the purchase order or the material is rejected due to any reason whatsoever, the consignee shall be bound to return the same vehicle immediately. Once the material is unloaded from the vehicle, no dispute will be entertained by the seller, and the seller shall not be liable under any circumstances.
The invoice to the buyer will be on the actual weight of material. Weighment at the producer’s/seller’s stockyard weighbridge will be final for all types of accounting and can be witnessed by the buyer. However, in the case of F.O.R. site deliveries, the buyer may re-weigh the vehicle on-site to confirm the weight of the material; the tolerance of weight between two weighbridges will be +/- 5 kg/MT, which should be acceptable to the buyer.
Unloading of goods from the vehicle reach at the site will be on the buyer’s account, and the goods should be unloaded from the vehicle within three hours of the vehicle reaching the site. Any delay in unloading of goods from the vehicle at the site due to any reason, then the detention charges of the vehicle will be borne by the buyer.
Refund of balance Payment will be made after completion of the order within 7 days after receipt of mail from the buyer with bank account details.
The company shall not pay any interest, damages (including liquidated risk purchase), etc., for non-delivery of material for reasons beyond its control.
